Is Mediation Right for My Divorce?

From the perspective of a divorce attorney turned mediator, I understand the importance of agreements reached between the parties versus an order from a judge. Not only does mediation provide a cost benefit to the divorcing parties, as litigation can be extremely costly, it provides some peace of mind in that the parties are able to come together and reach agreements for the benefit of their children and finances rather than rolling the dice with a judge.

Think about it ... who is in a better position to make decisions for your children and your financial well-being than you? The answer is probably no one, especially a judge who does not know anything about you or your children.

Mediation affords the opportunity for the parties to come together in a relaxed and confidential environment in which you and your spouse may speak frankly with a neutral third party without judgment and without the fear of having whatever you say come back to bite you. Parties are under no obligation to come to agreements but are encouraged to put forth a good faith effort to resolve issues in a safe and non-confrontational environment.

Mediation can be held face to face with the mediator and both of the parties or in separate rooms. Sometimes due to the high level of emotion involved in divorces, mediators will often begin in separate rooms, but as the parties begin to close the gap in their positions, the mediator will move the parties into the same room. 

This is also a great opportunity for closure as it enables the parties to speak freely and openly about their viewpoint in a way that will make the party feel heard. Many times, that is half the battle.
